These Terms of Service describe, in general terms, the conditions under which organizations and their authorized users may access and use the FMS platform. They are provided for informational purposes and do not constitute legal advice.
Acceptance of Terms
By accessing or using the FMS platform, your organization and its authorized users agree to these Terms of Service. If your organization has a separate signed agreement with FMS, the terms of that agreement govern in the event of any conflict with this page.
Use of the Platform
FMS is a private, internal-use platform for hospital and healthcare facility furniture management — inventory tracking, relocation requests, maintenance and reupholstery coordination, and decommissioning. Access is limited to authorized personnel of a subscribing organization. The platform is not a public marketplace and does not support the purchase, sale, or exchange of furniture between unaffiliated organizations.
Users agree to use the platform only for its intended facilities-management purpose and not to misuse, reverse-engineer, or attempt to access data belonging to another organization's tenant.
Account Responsibilities
Your organization is responsible for maintaining the confidentiality of account credentials issued to its users and for all activity conducted under those accounts. Organizations should promptly notify FMS of any suspected unauthorized access or use of an account.
Limitation of Liability
FMS provides the platform on an "as available" basis. To the fullest extent permitted by law, FMS is not liable for indirect, incidental, or consequential damages arising from use of the platform, including delays in request processing or inventory data accuracy, except where such limitation is not permitted by applicable law.
Governing Law
These Terms are governed by the laws of the jurisdiction in which FMS is incorporated, without regard to conflict-of-law principles, unless otherwise specified in a separate signed agreement with your organization.
